Introduction

Welcome to Penge AS ("Penge", "we", "us" or "our"). By using our services, including the Penge app and the website https://www.penge.app, you agree to follow and be bound by these terms of use ("the Terms"). Please read these Terms carefully before using our services.

Acceptance of the Terms

By using our services, you accept these Terms. If you do not accept these Terms, you may not use our services.

Use of the service

Eligibility

Our services are only available to people who are 18 years or older. By using our services, you confirm that you are at least 18 years old.

Account and security

To use our services, you must create an account and give us accurate and complete information. You are responsible for maintaining the confidentiality of your account and password, and you are responsible for all activity that takes place under your account. You must notify us immediately of any unauthorised use of your account.

Permitted use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services to:

  • Transmit or upload viruses, malware or other harmful code.
  • Engage in unauthorised access, hacking or other harmful activity.
  • Send unwanted or unauthorised advertising, junk mail or spam.
  • Reverse engineer, decompile or disassemble our software, including testing API endpoints without our written permission.
  • Use our APIs unnecessarily, which may include overuse or misuse of the resources offered through the API services.

Payment and fees

Payment

Any paid features or subscriptions we offer are sold through Apple's App Store as in-app purchases. Apple processes the payment and handles billing in accordance with Apple's terms.

Refunds

Refunds for in-app purchases are handled by Apple through the App Store refund process, in accordance with Apple's terms.

Intellectual property rights

All intellectual property rights in our services, including copyright, trademarks and patents, belong to Penge AS or our licensors. You have no right to use our intellectual property without our express written permission.

Disclaimer

No warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

Limitation of liability

To the extent permitted by law, Penge AS shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or use, arising from or related to your use of our services.

Not financial advice

Penge provides tools and information to help you understand and organise your own finances. It does not provide financial, investment, tax or legal advice, and nothing in the app should be relied on as such.

Changes to the Terms

We may update these Terms from time to time. Changes take effect when they are published on our website. If we make major changes to the Terms, we will inform you by email or in the app.

Your continued use of our services after minor changes to the Terms constitutes your acceptance of the changed Terms. For major changes that may affect your privacy or your rights, we will ask for your explicit consent before you continue to use our services. All changes to the Terms, especially those affecting privacy and data protection, will be handled in accordance with the GDPR.

Termination

We reserve the right to terminate or suspend your account and access to our services, without prior notice, if you breach these Terms or engage in unauthorised or unlawful use of our services.

App Store and Apple

The app is distributed via Apple's App Store and is subject to Apple's standard Licensed Application End User License Agreement. These Terms are between you and Penge AS, not Apple, and Apple is not responsible for the app. Apple and its subsidiaries are, however, third-party beneficiaries of these Terms and may enforce them against you.

Governing law and jurisdiction

These Terms and your use of our services are governed by Norwegian law. Any disputes arising from or related to these Terms or our services shall be settled by the Norwegian courts. Any disputes concerning privacy will be handled in accordance with the GDPR. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your local courts.
